A Simple Analysis on Distinguishing and Determination the Tort of Computer Software Copyright

This article is an attempt in analysis about how to distinguish and determine the computer software copyright document tort.The author showed his opinion about substantive similarity plus contact through analyzing the applicability of SSO Standard,identification standard of the contact,etc.The author believes that the key lies in the onus of the proof. The people who enjoys right is only required to testify the possibility of the contact,the people who is suspicious of tort ought to testify the rational source of the contact,otherwise the tort should be affirmed.
