    Legal Regulation of Private Power of Super Platforms in Digital Society

    • As a new engine of current economic growth, super platforms have driven the transformation of traditional society to digital society, and formed a strong control force in the online market, that is, private power. Firstly, the study shows that the harm of the disorderly expansion of the private power of super platforms is manifested in three aspects: infringing on the interests of users, disrupting the order of market competition and harming the public interest. Secondly, it adopts from the analysis path of power traceability that the transfer of rights in user agreements, the acquiescence or authorization of government public power, and the self-empowerment in technology preemption constitute three sources of private power of the super platforms. At the end, according to different sources, suggestions are provided from three aspects: governing the platform user agreement, clarifying the boundary of the platform power, and standardizing the application of platform technology, in order to further regulate the disorderly expansion of the private power of super platforms, and implement their responsibilities.
