    Posner's Theory About Economics of Law and Its Service as Reference

    • 摘要: 研究了法经济学的代表人物波斯纳的法经济学思想,认为波斯纳法律经济学理论坚持效益应当被看作是法律的基本价值,它的效益理论的价值和经济分析方法是法学理论领域的重大突破,其法经济学思想对于我国市场经济条件下法制建设具有重要的借鉴意义。

       

      Abstract: Posner's Theory about economics of law insists that efficiency should be regarded as the basic value of law. Its theory of efficiency value and method of economic analysis are a great breakthrough in law theory domain. The school will play a very important role in our market-oriented economy.
