证据保全之应有范围探析

摘要: 为使证据保全制度得以发挥实效,在完善我国证据保全机制时应重新界定证据保全的范围。对证据保全范围的完善应从2个方面入手:一方面,在保持现有证据有灭失或以后难以取得的情形外,应增加对方当事人同意和确定事、物现状等2种较能体现证据保全调查证据及疏减讼源等现代型功能的情形;另一方面,应将法院可以采取证据保全措施的时间延伸至诉讼之前。由此双管齐下,方能完整地界定证据保全适用之应有范围。Abstract: Proof preserving is a system that the courts protect proof and ensure the ability to prove facts including proof preserving before action and in the procedure.The scope of this system is not perfect in our country,so that it must draw up me all-round system of proof preserving.In addition,it must improve the function of the proof preserving system.
