恢复性司法的三维透视

See Restorative Justice from the Perspective of Three-dimensional Space

摘要: 恢复性司法旨在弥合因犯罪行为引起的被害人、被告人和社区创伤,恢复平等、和谐的社会关系和秩序。但恢复性司法对我国来说毕竟是个舶来品,我国能否加以借鉴并使之本土化还是一个未知数,亟待深入研究。文章从空间几何出发,借助三维立体结构对恢复性司法理念及在其指导下形成的诉讼构造进行阐释,同时,通过将传统的报应性司法模式和现代的恢复性司法模式分别置于“二维空间”和“三维空间”中进行比较,总结出恢复性司法本土化所面临的挑战和问题。

Abstract: The purpose of restorative justice is to restore ravage of the victims,appellee, community,and to restore the equality and harmony of social relationship and order.But restorative justice is exotic in China.Whether China will accept it and promote the localization of restorative justice is unknown.And it needs to be further studied.This article explains the basic theory of restorative justice from the perspective of three-dimensional space and analyses the challenges and problems of the localization of restorative justice by comparing restorative justice in three-dimensional space with retributive justice in two-dimensional space.
