防控金融犯罪的刑事政策研究

摘要: 金融犯罪是高发性、高危害性犯罪,要达到整治和预防金融犯罪的目标,必须对相关刑事政策进行研究和调整。通过历史分析法、比较研究法,总结和分析了金融犯罪以往的刑事政策,并对金融犯罪应采用的刑事政策提出了设想。认为应根据“宽严相济”的总体要求,按照“严而不厉,渐进调适”的思维设计刑事政策。其中“严而不厉”指保持高压性的刑事规制姿态的同时,妥善解决“刑罚过分依赖症候”的倾向;“渐进调适”指充分考虑制度环境,采取连续性、平稳性、阶段性的方式来构架各个环节、各个方面的刑事政策,避免对金融生态造成过于剧烈的扰动。

Abstract: Financial crime is the one with high incidence and high harmfulness.It is necessary to analyze the criminal policy by the way of historical analysis and comparative research.We should expand the financial crime circle;establish a strict criminal law net and relatively mild punishment In order to avoid the unrest of financial ecology,continuous and stable ways should be considered to make the criminal policy of financial crimes.
