Abstract: Expanding the natural person into the applicable scope of the bankruptcy law is the unified tendency of the bankruptcy legislation of modern countries. The discharge system is an important part of the natural person bankruptcy, and is at the core position of the relief policy of the natural person bankruptcy. Also, it is an important safeguard whether the natural person bankruptcy system can implement smoothly. This article mainly uses the comparative analysis method. By means of analyzing the legislation thoughts of the discharge system in other countries, analyzing our newly promulgated bankruptcy law and the bankruptcy law draft of 2003, this paper elaborates the legal value of the bankruptcy discharge system, and proposes some individual ideas on the bankruptcy discharge system.
