摘要: 财产信托制度是美国现代成年监护制度的一个重要组成部分,它的发展水平直接影响着成年监护制度的运行与发展,关系到欠缺行为能力成年人利益的保障与维护。经过多年的实践,美国成年监护制度中的财产信托制度迅速发展,取得了引人瞩目的社会效益。美国信托制度的理念内涵与实践经验,对于进一步改善我国欠缺行为能力成年人的生活状况,提高其经济保障水平,建立健全相应的配套制度,促进我国成年监护制度的进一步完善,具有十分重要的借鉴意义。Abstract: Property Trust system is an important component of the modern adult guardianship system in the United States.Its developmental level will directly exert affects on the operation and development of the adult guardianship system and is related to protection and the maintenance for the interests of the incapacitated adults.After practicing for many years, the property trust system in the United States adult guardianship system experienced a rapid development and achieved remarkable social benefits.The inner concepts and practical experience of U.S.property trust system are an important reference to further improving the living conditions of the incapacitated adults,increasing the level of economic security, establishing and improving the corresponding supporting system and promoting the further development of China's adult guardianship system.
