Study on Administrative Factual Behavior under the Idea of Administration According to Law

摘要: 在对行政事实行为进行界定的基础上,分析了行政事实行为与法律优位原则、法律保留原则、比例原则与信赖保护原则的关系,阐释了现代法治国家要求包括行政事实行为在内的任何行政行为皆必须服膺依法行政的要求。

Abstract: On the basis of the defining administrative factual behavior,the paper analyses the relationship between administrative factual behavior and the principle of administration according to law,pointing out that the administrative behavior including administrative factual behavior should obey the rule of law.
