论我国环境刑法中严格责任的适用

The Application of Strict Responsibility in Chinese Environmental Criminal Law

摘要: 现代意义上的刑法严格责任源于英美法系刑法理论,尽管仍然存在一些争议,但考虑到环境犯罪的复杂性以及惩治环境犯罪的特殊性,认为应该在我国的环境刑事立法中引进严格责任原则,并指出这不仅符合世界各国环境立法的发展趋势,而且在完善我国环境立法方面具有重要意义。

Abstract: This paper discusses that though the strict responsibility of criminal law remains contentious. It is necessary to introduce the foreign system of strict responsibility of criminal laws to China because it is both in keep with the world development and meets the needs of Chinese environmental legislature reformation.
