网络环境下著作权保护的利益平衡——以技术保护措施与合理使用的协调为视角

The Balance of Interests of Copyright Protection Under the Network Environment From the Perspective of Technological Protection Measures and Coordination of Fair Use

摘要: 网络环境下的技术保护措施在给著作权人充分保护的同时,限制了公众的合理使用和对作品公共部分的接触,著作权原有的利益平衡被打破。恢复著作权的利益平衡,关键在于“合理使用”能否成为规避技术保护措施的理由这一问题的解决,其也是技术保护措施与“合理使用”能否协调的关键。文章采用比较分析法、案例分析法,从“合理使用”作为著作权法利益平衡机制的角度出发,分析了上述问题,认为“合理使用”应当为规避技术保护措施的法律理由,并以“合理使用”为核心提出对技术保护措施限制的建议。

Abstract: Technological protection measures are a double-edged sword in the network environment,which fully protects copyright holders and limits the public' s reasonable use and contact with the public part of works.The original copyright interests balance is broken. The key of recovering copyright interests balance is the solution to whether the rational use could become the reason for avoiding the measures of technological protection.It is also the key to the point whether the technological protection measures and rational use could be coordinated.By adopting the methods of comparative and case analysis,this article believes fair use should become the legal reason to avoid the technological protection measures from the view of fair use as mechanism of balancing interests in copyright law.
