Abstract:
The development of digitalization, networking and intellectualization has given rise to new forms of employment, in which artificial intelligence is widely used in areas such as intelligent scheduling, intelligent management, intelligent voice interaction, intelligent customer service, intelligent logistics and virtual live broadcasting. While artificial intelligence empowers new forms of employment, it also triggers lotsof legal challenges. Algorithmic control of workers in new forms of employment, artificial intelligence's infringement on privacy rights and personal information of workers, consumers, and other personality and property rights, and artificial intelligence's competition with workers in new forms of employment, are the challenges that require an urgent legal response. Based on this, at the macro level, the governance of artificial intelligence in new forms of employment shall follow a number of basic principles, balance the interests of multiple subjects, and form a multifaceted normative synergy. At the micro level, by combining legislation and legal interpretation, the corresponding specific problems can be solved through the algorithmic regulation, clarification of the subjects'artificial intelligence infringement liability and the principle of attribution of responsibility. The measures at both micro and macro levels can give full play to the auxiliary role of artificial intelligence.
