Abstract:
With the advent of the era of artificial intelligence, the employment sector is facing both long-term employment pressure and structural contradictions, as well as an urgent need to adapt to the impact of the new round of technological revolution. The current employment legislation in China presents distinct problem-oriented and promotion-oriented characteristics in legislation, focusing on the narrow governance context of "people" and "problem-solving" governance logic. This type of employment promotion legislation cannot adapt to the new scenario of "people" and "technology", nor can it truly respond to the new goal of building an employment-friendly development mode. In this regard, employment legislation in the era of artificial intelligence needs to adhere to the basic positioning of "promotion", together with the value of "friendliness" in future employment legislation, so as to safeguard human dignity, achieve human development, and protect human equality in the era of artificial intelligence. Specifically, based on the legislative paradigm of promoting friendly employment, governments should improve their responsibilities in regulation, management, and guarantee as the main content, effectively integrate cooperative governance and incentive compatibility in the construction of corporate responsibility, and strengthen the legal protection of workers' rights and interests in individual or large-scale layoffs in face of new forms of employment due to the introduction of artificial intelligence technology.
