平台型非标准就业与劳动力市场规制

    Platform Non-standard Employment and Labor Market Regulations

    • 摘要: 从非标准就业的视角出发,平台就业分为平台型标准就业和平台型非标准就业。以网约车平台就业为例,通过对网约车驾驶员就业状况调查数据的分析,表明平台型非标准就业对促进农村人口和受教育程度较低人口的就业、对增加家庭收入具有一定的作用及意义,同时也存在较为突出的超时劳动和社会保险缺失两大问题。在劳动力市场规制方面,平台型非标准就业在中国现行劳动法律法规中基本处于空白状态,给劳动者权益保障带来挑战。中国在支持和依托平台就业等新就业形态扩大就业的同时,应进一步加强用工规范和管理,及时应对平台就业对现行劳动力市场规制提出的新挑战,有效化解对劳动管理的负面冲击。

       

      Abstract: From the perspective of non-standard employment, this study categorizes platform employment into platform standard employment and platform non-standard employment. Using national investigation data on platform employment of taxi drivers, this study finds that platform non-standard employment plays a pivotal role in promoting employment particularly for rural laborers and those with lower level of educational attainment, and it has livelihood significance in terms of raising income for laborers. However, two issues, i.e., working overtime and the lack of social insurance, are quite prominent. With regard to labor market regulations, there are few protections targeting platform non-standard employment in the contemporary system, imposing challenges to protection of labor rights in this employment category. While supporting and using platform employment and other new forms of employment to expand employment, it is crucial to strengthen employment management and labor market regulations, respond to new challenges generated by platform employment against current labor law and regulations, and respond to its negative impacts on labor management.
